Division of Property

Division of property between spouses is a difficult issue to resolve during a divorce. It encompasses all forms of assets and debts, from vehicles and real estate to business interests, and retirement accounts. In Iowa and Illinois , property division also includes assignment of debts owed by either or both parties. Many factors weigh upon how a court will divide property, including whether property was premarital, inherited or gifted. You should seek Justin’s advice, as this is a complicated area of family law.

Equitable Distribution

In equitable distribution states, including Iowa and Illinois , all property, whenever or however acquired, regardless of legal title, is subject to equal or unequal division. “Equitable” does not mean equal. Courts strive for a fair division between the parties and take into consideration several factors to make that determination. These factors are set by statute, and an experienced family lawyer can guide you in interpreting the law as it applies to your individual situation.
